This is a draft prepared for legal review before publication. Sections on liability, refunds, and dispute resolution in particular should not go live without qualified legal review.
1. Acceptance
By creating a Qhello account or ordering a Qhello card, you agree to these Terms. If you don't agree, please don't use Qhello.
2. What Qhello is
Qhello (a product of Vercura Systems) provides physical cards (Standard, Matte Black, Wood tiers) embedded with QR/NFC technology linking to a digital profile you control, along with the dashboard, subscription, and related services to manage them.
3. Accounts
- You must verify your phone number via one-time code to create an account.
- You're responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorized access.
- One phone number may be associated with one account.
- Accounts created via gifting are not active until the recipient completes phone verification and claims the account.
4. Subscriptions and pricing
- Card tiers, subscription plans, and pricing (including any regional pricing) are set by Vercura Systems and may change; changes to your active subscription price, if any, will be communicated in advance.
- Promotional/founding-member pricing, where offered, applies under the specific terms stated at the time of purchase.
- Subscriptions renew automatically unless cancelled before the renewal date.
5. Orders and delivery
- Card orders are fulfilled based on the delivery estimate shown at checkout; estimates are not guaranteed delivery dates.
- Once a card enters production, it may not be cancelled or refunded — [confirm exact refund policy with legal/business decision].
- Risk of loss for a physical card passes to you upon delivery to the address provided.
6. Acceptable use
You agree not to:
- Use Qhello to impersonate another person or misrepresent your identity
- Attempt to access another user's account or card data without authorization
- Use the platform to send unsolicited or abusive communications
- Attempt to circumvent scan limits, subscription gates, or security measures
- Use automated tools to scan, enumerate, or scrape card links
Violation of these terms may result in account suspension or termination.
7. Content and links
- You are solely responsible for the accuracy and legality of the social links, contact information, and any custom greeting messages you attach to your cards.
- We reserve the right to remove or deactivate cards/accounts found to contain unlawful, abusive, or fraudulent content.
8. Gifting
- If you order a card as a gift, you are responsible for payment of the card and any prepaid subscription period. The recipient is not obligated to claim or activate the gifted card.
- Rewards ("stars") earned through gifting have no cash value and may only be redeemed for the benefits described in the app at the time of redemption.
9. Intellectual property
- The Qhello name, brand, design system, and platform are the property of Vercura Systems. Your account content (your name, links, greeting messages) remains yours.
10. Disclaimers and limitation of liability
- Qhello is provided "as is." We do not guarantee uninterrupted service, and are not liable for indirect or consequential damages arising from use of the platform, to the maximum extent permitted by applicable law. [This section requires legal drafting specific to Nigerian consumer protection law before publication.]
11. Termination
- You may delete your account at any time. We may suspend or terminate accounts that violate these Terms.
12. Governing law
- These Terms are governed by the laws of the Federal Republic of Nigeria. [Confirm venue/jurisdiction with legal counsel.]
